1. Agreement
By accessing Hawkins3D (“we,” “us,” or “our”) operated by Hawkins Technologies LLC, you agree to these Terms. If you disagree, do not use our website or services.
2. Services
We provide Matterport-related 3D capture, processing, and related creative services as described in your order, proposal, or statement of work. Deliverables, licensing, and hosting terms may incorporate third-party platforms (such as Matterport); their applicable terms may also apply.
3. Scheduling & access
You are responsible for securing property access, permissions from occupants, and accurate property information. Missed or delayed access may result in rescheduling fees as stated in your quote.
4. Payment
Fees, deposits, and invoicing terms are set in your agreement. Late payments may incur charges or pause delivery of files or hosting handoff as permitted by law.
5. Intellectual property
Unless otherwise agreed in writing, you grant us permission to capture the property and we grant you usage rights to the deliverables for agreed marketing purposes. Portfolio use of anonymized or public marketing samples may be specified separately.
6. Disclaimers
Services and deliverables are provided “as is” to the extent permitted by law. We are not responsible for MLS rules, brokerage policies, or platform changes that affect how you may use media.
7. Limitation of liability
To the maximum extent permitted by law, our total liability arising from these terms or our services is limited to the fees you paid us for the specific engagement giving rise to the claim, unless a different cap is set in a signed agreement.
8. Changes
We may update these Terms periodically. Continued use after changes constitutes acceptance of the revised Terms.
